WHIPLASH COMPENSATION CLAIMS UK
What is whiplash?
Almost all motor accidents resulting in injury give rise to whiplash compensation claims. UK solicitors who specialise in personal injury are usually very familiar with the particular problems of these cases. This injury is normally caused when the neck is whipped backward forcefully. It involves injury or damage to the muscles, tendons, disks and nerves in or around the neck and often produces pain and stiffness in the front and/or the back of the neck. Symptoms may occur immediately after an accident or incident but can also not appear for several days in some cases. The injury is usually caused by sudden acceleration and deceleration of the head and neck.
What should I do?
It is imperative that you gain medical treatment quickly if you have not already done so.
Contact us and we will immediately have the matter placed in the hands of a highly experienced personal injury solicitor who will review the matter and advise if you have a claim against any person.
What can I claim for?
General Damages
These relate to the actual pain and suffering caused by the accident itself. To determine these damages the solicitor will arrange for you to be examined by a medical expert (at no cost to you). When applicable, an award for being disadvantaged in the employment market or having to change your lifestyle can also be made. Judges are assisted in determining what level of damages applies by what is known as the JSB (Judicial Studies Board) Guidelines and review of previous awards in similar cases. Our solicitors also have access to these guidelines.
Special Damages
These relate to specific matters such as loss of earnings (both past and future), cost of medical treatments, travel expenses, loss of personal property damaged in the accident and similar specific expenses such as an excess under a motor insurance policy.
What do whiplash compensation claims cost?
NOTHING – our solicitors when they accept a case will act on a “No Win – No Fee” basis and we will not deduct any money from an award of damages made to you. If you are awarded £5,000 you keep £5,000. Our solicitors are paid by the losing opponent or their insurer but only if the case wins. We will also make sure you are protected in the unlikely event that your case does not win.
