MOTOR INSURERS BUREAU - UNINSURED DRIVER

What if the other driver was not insured at the time of the accident.

A large proportion of UK car accidents involve an uninsured driver. In these cases a claim can be made to the Motor Insurers Bureau (MIB) which administers a fund which is contributed to by a levy on all insurance companies. The purpose of the fund is to pay compensation to the victims of uninsured and untraced drivers. If the identity of the driver is known but the driver is uninsured then the fund will pay all normal compensation and legal costs subject to the deduction of a nominal excess. We can make an application for you on a no win no fee basis and compensation is paid in full with no deductions.

What if the other driver is not identified and did not stop after the accident.

If the other driver is untraced which sometimes happens in hit and run car accidents then the MIB will only pay compensation for personal injury together with some associated losses but will not pay for property damage including damage to vehicles. In these cases the MIB do not pay for the legal costs of an application which must be deducted from any compensation awarded. Compensation in these cases is not paid in full. How does it all work?

  • We obtain as much information as possible about what happened and the injuries you have sustained.
  • We pass this information to the appropriate personal injury solicitor on our panel.
  • The panel solicitor deals directly with you by telephone and correspondence – normally you do not even need to visit his or her office.
  • The claim is detailed and an application is made to the MIB who may appoint an insurance company to deal with claim on their behalf.
  • Normal enquiries are made into the circumstances of the accident and evidence to back up the claim is obtained including, where appropriate, medical reports.
  • If accepted as a case involving negligence by the other driver the Motor Insurers Bureau will thereafter make an offer to settle which, if unsatisfactory can, in the case of an uninsured driver who has been identified, be litigated in the court and in the case of an untraced driver be appealed firstly to the MIB’s assessors and thereafter to an independent arbitrator.
  • In the case of a traced but uninsured driver compensation is paid in full with absolutely no deductions however in the case of an untraced driver any legal costs will be deducted from the MIB award however both types of claim are dealt with using the no win no fee scheme.
